The deadline to file. In most New Jersey personal injury cases, you have two years from the date of the injury to file a lawsuit. Shared fault does not always end your case. New Jersey follows a modified comparative negligence rule. As long as you are not more at fault than the other party or parties, you can still recover, though your award is reduced by your share of the blame. If you are found 51 percent or more at fault, you recover nothing. Car accidents and the lawsuit limitation. New Jersey is a no-fault auto state.
